Agency Facts for the Buyer
  • If a listing agent is showing a property for which he has a contract with the seller, then he is actually a seller's agent and owes his allegiance to that seller. However, a seller's agent can perform important services for the buyer, including preparing offers according to the buyers specifications. He must be fair and honest to all parties, but he does represent the best interests of the seller.
  • Unless the cobrokering real estate agent and the buyer are working under a "buyer agency" agreement, the co-broker is legally a selling agent and is obligated to working the best interest of the seller.
  • If an agent is not the listing agent on a property, he or she may represent the buyer through a buyers agency agreement, thus representing the buyers best interests and negotiating on the buyers behalf.
  • Upon your first meeting with an agent, it is important that you and the Realtor come to an understanding of whom the the agent is to represent in subsequent dealings. Some buyers prefer to be customers with the full knowledge that the agent works for the seller; other buyers wish to have an agent represent their interests only and enter into a Buyers Agency Agreement
  • That is why we now have "buyer's agents". Only a "buyer's agent" can represent and work for the best interests of the buyer.
  • Only a buyer's agent is not limited to showing properties only listed in MLS.
  • Only a buyer's agent is obligated to provide complete confidentiality of the buyers personal motives or financial intentions. Without this confidential duty, a seller might gain a bargaining edge.
  • Only a buyer's agent can advise and counsel a buyer with unrestricted assistance, providing as much assistance as needed.



What is a "Buyer Agency" contract? A "Buyer Agency" contract creates legal responsibilities between the buyer and the agent:
Loyalty to the buyer Disclosure of information
Confidentiality in all matters Reasonable care and diligence
Accounting on all matters, including payment of services
